    7. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your Personal Information:

  1. Tracking Technologies and Advertising. You may refuse to accept browser cookies by activating the appropriate setting on your browser or mobile device. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

    10. Updates and Review of Account Information

You may review, update, or modify your or your account information directly on the Website by submitting a support ticket through the Website’s “Contact Us” page. You may also send us an email at privacy@360talentavenue.com to request access to, correct, or delete any Personal Information that you have provided to us. If you email us, please put “Review of Account Information” in the subject line. We cannot delete your personal information except by also deleting your user account. Please note that we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We reserve the right to retain your as necessary for recordkeeping and other compliance purposes to the extent allowed by applicable law, subject to your right of deletion of information.

    11. Data Security

We have implemented commercially reasonable measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls provided by third parties.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

We urge you to be careful about giving out information in public areas such as career pages. The information you share in public areas may be viewed by any user of the Website. Supplemental Website Privacy Policy for California Residents

Consumer’s online privacy rights vary from jurisdiction to jurisdiction. Accordingly, this section supplements the information contained in this Policy and applies solely to all visitors, users, and others who reside in the State of California. We adopt this section to comply with the California Consumer Privacy Act of 2019 (“CCPA”), and any terms defined in the CCPA have the same meaning when used in this Policy unless otherwise noted.

Under the CCPA, California residents are provided with specific rights regarding their Personal Information (as defined below). This section describes the categories of Personal Information, the rights afforded to California residents under the CCPA, and explains how to exercise those rights.

Please note that this section does not apply to workforce-related personal information collected from California-based employees, job applicants, contractors, or similar individuals. Also please note that the CCPA temporarily exempts Personal Information reflecting a written or verbal business-to-business communication (“B2B Personal Information”) from some of its requirements.

We do not sell Personal Information to any third party. And the CCPA prohibits a third party from reselling personal information unless you have received explicit notice and an opportunity to opt-out of further sales. 

B. Right to Know and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months (the “Right to Know”). Once we receive and confirm your identity (see Exercising Access, Data Portability, and Deletion Rights below), we will disclose to you: (i) the categories of Personal Information we collected about you; (ii) the categories of sources for the Personal Information we collected about you; (iii) our business or commercial purpose for collecting that Personal Information; (iv) the categories of third parties with whom we share that Personal Information; (v) the specific pieces of Personal Information we collected about you (also called a data portability request); and/or (vi) if we disclosed your Personal Information for a business purpose, we will identify the Personal Information categories that each category of recipient obtained. 

Please note that we do not provide these access and data portability rights for B2B Personal Information.

C. Deletion Request Rights

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions (the “Right to Delete”). Once we receive and confirm your identity (see Exercising Access, Data Portability, and Deletion Rights below), we will delete your Personal Information from our records, unless an exception applies.

 

We may deny your deletion request if retaining the information is necessary for us or our Service Providers to: (i) complete the transaction for which we collected the Personal Information, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you; (ii) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; (iii) debug products to identify and repair errors that impair existing intended functionality; (iv) exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law; (v) comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.); (vi) engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent; (vii) enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; (viii) comply with a legal obligation; and/or (ix) make other internal and lawful uses of the Personal Information that are compatible with the context in which you provide it. We will delete or deidentify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action. 

Please note that we also do not provide these deletions rights for B2B Personal Information.

D. Exercising Access, Data Portability, and Deletion Rights

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Information. You may only make a request to know twice within a 12-month period. 

Your request to know or delete must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information, which may include: providing your mobile number, full legal name, and/or email address; and (ii) describing your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. To designate an authorized agent, you must: sign a release of information form setting forth your authorized agent’s name and contact information. We will only use Personal Information provided in a request to verify the requestor’s identity or authority to make the request.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.

E. Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact: privacy@360talentavenue.com.

We endeavor to substantively respond to a request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days total), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. 

We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

F. Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of goods or services; or (iv) suggest that you may receive a different price or rate for goods or services or different level or quality of goods or services. However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
